Delaware’s Renewable Portfolio Standard Compliance and Green Power Products Compliance

GREEN POWER PRODUCTS COMPLIANCE

Retail Suppliers with retail sales of marketed Green Power Products need to submit a report by Sept. 28, 2022 26 Del. Admin. C. Sections 3001-13.0

Voluntary Renewable Energy Credits (VREC)s, RECs or SRECs retired cannot be used to meet compliance in successive years.

Green Power Products Compliance Report 2021 – A Green Power Product is defined as an Electric Supply Service which is marketed or otherwise advertised as having generation attributes consisting of the types of renewable energy sources listed in 26 Del. C. §352(6)(a)-(i). The Electric Supplier shall identify the percentage of renewable resources in the Contract.  Commission-regulated electric companies are responsible for complying with the Renewable Energy Portfolio Standards Act’s requirements as per 26 Del.C. §354(e).

Delaware RECs or SRECs submitted in compliance with this regulation may be dated no earlier than 3 years prior to the beginning of the current compliance year. See 26 Del. Admin. C. Section 3.3.3

Reports should include GATS or other regional renewable energy certificate tracking system or Green-e Energy documentation of retired VRECs, RECs and SRECs.

The report does not use fractional VRECs, RECs or SRECs. Fractions should be rounded up or down.

RPS COMPLIANCE

Beginning with the 2012 Compliance Year, Delmarva Power & Light is responsible for the RPS compliance obligation with respect to energy delivered to its End-Use Customers. See 26 Del. Admin. C. §3008 -3.2.3
