Renewable Energy Interconnection Facility CPCN


Renewable energy interconnection facility is any transmission facilities which include transmission lines, conduits, or any other equipment necessary to connect any solar, wind, or other renewable energy project with 30 MW of capacity or higher to the PJM transmission grid.

In accordance with 26 Del.C. §203(F), any person or entity wishing to construct and operate a renewable energy interconnection facility must first obtain a Certificate of Public Convenience and Necessity (CPCN) from the Commission.

The Commission has promulgated regulations to comply with 26 Del.C. §203(F), Regulations Governing Certificate of Public Convenience and Necessity for the Siting of Renewable Energy Interconnection Facilities, codified at 26 DE Admin. Code 3014.

How to File Applications

All applications should be filed in the Commission’s electronic filing system, Delafile, https://delafile.delaware.gov/.  Applications have a filing fee of $750 which is paid when filed in Delafile.

Before filing an application in Delafile:

  1. The Company must be registered in Delafile.  If the company is not yet registered, complete a Company Registration form and send the completed form to DealfileAdmin@delaware.gov.
  2. The user(s) must be registered.  Complete the user registration using the link on the Delafile homepage.
  3. When submitting the application in Delafile, select ‘Electric’ as the Utility Type and ‘Transmission CPCN’ as the Type of Docket.

DO NOT E-FILE OR MAIL ANY CONFIDENTIAL DOCUMENT OR CONFIDENTIAL INFORMATION USING THE DELAFILE WEBSITE OR MAIL UNLESS YOU SIMULTANEOUSLY ALSO E-FILE OR MAIL 1) A REDACTED, PUBLIC VERSION OF THE SAME DOCUMENT; AND 2) AN ATTESTATION THAT THE INFORMATION IS NOT SUBJECT TO PUBLIC INSPECTION OR DISCLOSURE.

If you file any confidential documents without a corresponding redacted, public version and attestation, your filing will not meet the Commission’s minimum filing requirements and will be rejected. All rejected documents are not considered as legally filed documents per the Commission’s Rules and do not start any time limits set for a response from the Commission or its staff.
