The Rules for and Regulation of Community Energy Facilities are found in 26 Del. Admin. C. 3013. They can also be found in the Commission’s Delafile e-filing system by searching for Reg. 66 as the docket number.

Applications should be filed in the Public Service Commission’s DelaFile e-filing system. There is a $750.00 filing fee for each Preliminary Certificate to Operate application.

All Community Energy Facility applications should be filed in the Commission’s electronic filing system, DelaFile. Before the application for a Preliminary Certificate to Operate can be submitted in DelaFile two actions are required:
1) a company representative must be registered as a system user in order to file documents and:
2) the company must be registered as a Community Energy Facility in the system by completing and submitting the following form: Community Energy Company Registration.

Additional employee registrations may be completed later. Only registered DelaFile users can file an application, file additional docket information after the initial filing or file a report in DelaFile. After your company and company representative are registered in DelaFile you can submit the application for Preliminary Certificate to Operate with a $750.00 filing fee. Please see the application package for required documentation to be filed.
Preliminary Certificate to Operate
An application for a Final Certificate to Operate may be filed after a Preliminary Certificate to Operate has been granted. Remember that a Preliminary Certificate to Operate expires 24 months after issuance. There is no filing fee for the FCTO. Please see the application package for required documentation to be filed.
The following is a list of community solar projects who have had preliminary and final certificates to operate approved by the Commission.
In accordance with the Rules for and Regulation of Community Energy Facilities, companies are required to provide various reports to the Commission after a Final Certificate to Operate has been issued. All reports must be filed in Delafile. These include:
Annual Report- All Community Energy Facilities with a Final Certificate to Operate must file an annual report by April 30th of each year. The report is found below to complete and file in Delafile.
Annual Assessment- All Community Energy Facilities with a Final Certificate to Operate must file and pay the annual assessment provided in 26 DE Admin. C. 3013-14.0 by March 31 of each year. In accordance with the Rules, the “gross operating revenue” shall equal the sum of the net-metering credits produced by the facility and revenue derived from unsubscribed energy.
